CaseLink Privacy Policy

Introduction

CaseLink, operated by Envisage Companies, LLC, respects your privacy and is committed to protecting the information submitted through the CaseLink portal and related services. This Privacy Policy explains what information we collect, how we use it, how we protect it, when we may disclose it and what choices may be available to you.

By accessing or using the CaseLink portal, website or related services, you agree to this Privacy Policy.

Information We Collect

We may collect information that you provide directly to us, including your name, firm name, business name, email address, username, mailing address, phone number, account information, uploaded documents, client matter information, billing information and other information voluntarily submitted to request, support or complete CaseLink services.

If you submit client files, medical records, insurance documents, claim materials, accident records, settlement documents, billing records, litigation-related materials or other case-related records, those records may contain personal information, protected health information, confidential information, attorney-client privileged information or attorney work product.

We may also collect limited technical and system information needed to operate and secure the portal, including IP address, device information, browser type, login activity, authentication data, access logs, date and time stamps, pages viewed and actions taken within the portal.

If payment processing is enabled, payment information may be collected and processed by our third-party payment processor. CaseLink does not intentionally store full credit card numbers or banking credentials unless expressly disclosed at the time of collection.

Summary of Data Practices

We do not sell personal information. We do not share personal information for cross-context behavioral advertising. We do not use client matter files, medical records or privileged information for advertising purposes.

CaseLink collects and uses information only as reasonably necessary to provide, operate, maintain, support, secure and improve its portal and legal-support services.

How We Use Information

We may use information to register and manage accounts, receive and organize case materials, prepare requested legal-support deliverables, communicate with users, provide customer support, process authorized payments, maintain security, prevent fraud or misuse, comply with legal and contractual obligations, enforce our agreements and improve our services.

CaseLink provides legal-support services only. CaseLink does not provide legal advice, legal representation or attorney-client services.

Who We Share Information With

We may disclose information only as reasonably necessary to provide and protect CaseLink services, including to service providers that support hosting, cloud storage, security, payment processing, email delivery, customer support, document processing, software operations or other business functions.

We may also disclose information to professional advisers, including attorneys, accountants, auditors, insurers or compliance consultants; to law enforcement, courts, regulators or government authorities when required by law, subpoena, court order or legal process; or to successors or assigns in connection with a merger, acquisition, restructuring, financing, sale of assets or transfer of business operations.

We do not sell your personal information.

Artificial Intelligence and Third-Party Processing Tools

We do not submit client matter files, medical records, protected health information or privileged information to artificial intelligence tools or third-party processing tools unless authorized by the account holder, required to provide the requested services, protected by appropriate confidentiality and data protection terms, or otherwise permitted by applicable law or contract.

Where practical, we limit, redact, anonymize or deidentify information before using third-party tools for operational support, testing, troubleshooting, analytics or service improvement.

Data Security

CaseLink uses reasonable administrative, technical and physical safeguards designed to protect information from unauthorized access, disclosure, alteration or destruction. These safeguards may include access controls, password protections, authentication tools, encrypted transmission, restricted user permissions, secure hosting practices, monitoring, audit logs and internal confidentiality controls.

Files uploaded through the portal are stored using Backblaze cloud storage, and CaseLink maintains a signed Business Associate Agreement with Backblaze for protected health information handled through the storage environment.

Although no electronic system, internet transmission or cloud storage platform can be guaranteed to be completely secure, CaseLink takes reasonable measures to protect your information, including secure storage practices, access controls, restricted permissions and confidentiality safeguards.

HIPAA, Confidentiality and Client Matter Information

CaseLink may receive documents that contain protected health information, sensitive personal information, confidential business information, attorney-client privileged communications or attorney work product.

CaseLink provides legal-support services including demand letter preparation support, medical record organization, medical chronology support, case file review, billing summary support and related pre-suit document support services. CaseLink does not provide legal advice, medical advice, claims handling, document review for legal accuracy, compliance review or approval of uploaded materials.

The account holder and its authorized users remain responsible for determining whether uploaded materials may be lawfully submitted to CaseLink and for obtaining any required client authorizations, patient authorizations, consents, notices, agreements, permissions or Business Associate Agreements before uploading protected health information or other regulated information.

Where required by law or contract, CaseLink will enter into a Business Associate Agreement, confidentiality agreement, data protection agreement or similar written agreement before receiving protected health information or other regulated information.

Security Incident and Breach Notice

If CaseLink becomes aware of a security incident involving protected health information or personal information maintained through the portal, CaseLink will investigate and take reasonable steps to mitigate harm.

If notice is required under HIPAA, HITECH, Florida law or another applicable law, CaseLink will provide notice to the affected client or covered entity as required by applicable law and the applicable Business Associate Agreement.

Where CaseLink acts as a third-party service provider or business associate, CaseLink will notify the client or covered entity of a reportable breach as expeditiously as practicable and within the time required by applicable law or contract so that the client or covered entity can satisfy any required individual, regulatory or governmental notices. Florida law requires a third-party agent to notify the covered entity no later than 10 days after determining or having reason to believe a breach occurred. Florida law requires covered entities to notify the Florida Department of Legal Affairs when a breach affects 500 or more Florida residents, generally no later than 30 days after determining or having reason to believe a breach occurred.

Privacy Requests

To submit a privacy request, contact us at info@CaseLink.com. Please include “Privacy Request” in the subject line so your request can be properly identified and reviewed. We may need to verify your identity and authority before processing your request. We will acknowledge receipt of your request within five business days and will respond within the time required by applicable law.

Children's Privacy

CaseLink services are intended for use by law firms, legal service providers, claims professionals and other authorized business users. They are not directed to children under 18.

We do not knowingly collect personal information directly from children under 13.

Changes to This Privacy Policy

We may update this Privacy Policy periodically. When we make changes, we will update the “Last Revised” date above. Material changes may be communicated by email, portal notice or other reasonable method.
